Our store is powered by Shopify Inc. (“Shopify”), which provides the e-commerce platform enabling us to sell our products to you.

These Terms of Service (“Terms”), together with any policies referenced herein (including our Privacy Policy and Refund Policy), govern your access to and use of the Services.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account.

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to display accurate product descriptions, photographs, and representations. However, colors, finishes, textures, and appearance may vary based on screen settings, lighting, materials, and the handmade or small-batch nature of our products.

WE DO NOT GUARANTEE THAT PRODUCT APPEARANCE, SCENT, OR PERFORMANCE WILL MEET INDIVIDUAL EXPECTATIONS.

All product descriptions, availability, and pricing are subject to change without notice. We reserve the right to discontinue any product at any time.

SECTION 3 – PRODUCT SAFETY, ASSUMPTION OF RISK, AND PROPER USE

Our products—including but not limited to candles, wax melts, and fragrance products—are intended for personal, household use only and must be used strictly in accordance with all safety instructions, warnings, and guidelines provided on product packaging, inserts, labels, or our website.

Candles and wax melts involve open flame, heat, or melted wax and inherently carry risks, including fire, burns, property damage, and injury.

BY PURCHASING OR USING OUR PRODUCTS, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOU ASSUME ALL RISKS ASSOCIATED WITH THEIR USE OR MISUSE.

Backbone Craft Company, LLC is not responsible for damage, injury, or loss caused by: leaving a candle unattended; improper placement near flammable materials; burning beyond recommended time limits; failure to follow provided safety instructions; or negligent or unintended use.

Use of our products is entirely at your own risk.

SECTION 4 – FRAGRANCE SENSITIVITY & ALLERGIES

Our products may contain fragrance oils, essential oils, or other ingredients that may cause sensitivities or allergic reactions in some individuals. Scent perception, strength tolerance, and reactions vary from person to person.

You are solely responsible for determining suitability. Discontinue use immediately if irritation, discomfort, or adverse reaction occurs.

FRAGRANCE PREFERENCE, SCENT STRENGTH, OR INDIVIDUAL SENSITIVITY IS NOT A DEFECT AND IS NOT GROUNDS FOR A RETURN OR REFUND.

SECTION 5 – ORDERS

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion. An order is not accepted until payment has been processed and confirmation is issued.

By submitting your order, you confirm that you have reviewed all items, quantities, and shipping details prior to checkout. You acknowledge that you understand what you are purchasing.

Orders may not be canceled or modified once accepted.

Purchases are subject exclusively to our Refund Policy.

All purchases are for personal or household use only and not for resale.

SECTION 6 – PRICES AND BILLING

Prices are subject to change without notice. Posted prices do not include taxes, shipping, or handling unless expressly stated.

By completing your purchase, you represent that you are the authorized holder of the payment method used, or that you have explicit permission from the authorized holder to use it. You authorize us to charge your payment method for all amounts due at the time of purchase. You are responsible for providing accurate and up-to-date payment information.

SECTION 6A – CHARGEBACKS, BILLING DISPUTES, AND PAYMENT VERIFICATION

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY BEFORE COMPLETING YOUR PURCHASE.

Contact Us Before Filing a Dispute. Before initiating any chargeback, payment reversal, or billing dispute with your bank, credit card issuer, or payment provider, you agree to contact Backbone Craft Company, LLC directly at support@backbonecraftco.com and allow a minimum of five (5) business days for us to respond and attempt to resolve the issue. Failure to contact us first may be considered a breach of these Terms, and we reserve the right to contest any chargeback and submit all relevant evidence—including order records, communications, IP address logs, and purchase confirmation data—to our payment processor.

Billing Statement Descriptor. All purchases made through our store will appear on your bank or credit card statement as “SP BackboneCraftCo-425.” By completing your purchase, you acknowledge that you are aware of and recognize this billing descriptor. If you do not recognize this charge upon reviewing your statement, please contact us at support@backbonecraftco.com before filing a dispute with your financial institution.

Authorized Purchase Acknowledgment. By completing checkout, you confirm that the transaction is authorized, intentional, and made with full knowledge of the items being purchased and the total amount charged. Initiating a chargeback for a purchase you authorized constitutes fraudulent misrepresentation, and we reserve the right to pursue all available remedies.

Chargebacks Inconsistent with Our Refund Policy. Chargebacks filed for reasons that fall outside our published Refund Policy—including but not limited to buyer’s remorse, fragrance preference, or failure to read product descriptions—will be disputed by us. You agree to cooperate fully in any such dispute resolution process.

SECTION 7 – SHIPPING AND DELIVERY

We currently ship within the United States only.

Shipping times are estimates and not guaranteed. We are not responsible for carrier delays, weather events, customs issues, or circumstances beyond our control.

RISK OF LOSS PASSES TO YOU UPON DELIVERY TO THE CARRIER.
We are not responsible for lost, stolen, or misdelivered packages once marked delivered.

SECTION 8 – INTELLECTUAL PROPERTY

All content, branding, product names, images, text, graphics, logos, and designs are the exclusive property of Backbone Craft Company, LLC or its licensors and are protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, or exploit any portion of the Services without prior written consent.

SECTION 9 – OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available” without warranties or endorsements. We assume no liability arising from your use of third-party tools.

SECTION 10 – THIRD-PARTY LINKS

We are not responsible for third-party websites or services linked through the Services. Use of third-party content is at your own risk.

SECTION 11 – RELATIONSHIP WITH SHOPIFY

Backbone Craft Company, LLC is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Backbone Craft Company, LLC. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Backbone Craft Company, LLC, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Backbone Craft Company, LLC.

Your use of the Services is subject to our Privacy Policy and Shopify’s Privacy Policy.

Any dispute shall be resolved by binding arbitration on an individual basis. You waive the right to participate in class actions or class arbitration.

SECTION 22 – ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Backbone Craft Company, LLC.

We may assign these Terms without notice. You may not assign without consent.

SECTION 24 – GOVERNING LAW

These Terms are governed by the laws of the State of Iowa, without regard to conflict-of-law rules. Venue shall lie exclusively in Iowa courts.

SECTION 25 – CHANGES TO TERMS

We may update these Terms at any time. Continued use constitutes acceptance.
